Police identify armed man shot by trooper in Lee
UPDATE: State police have identified the Lee man who was shot in the hands by a trooper after the armed suspect fired a rifle in the air and then pointed the weapon at the trooper in the town of Lee Tuesday night.
James Newbill, 41, of 9110 Meadow Brook Drive is currently recovering from non-life threatening injuries at University Hospital, where he also is awaiting felony charges in connection with Tuesday’s incident, police said.
Trooper Shane Treen of the Marcy barracks responded to Newbill’s Meadow Brook Drive home at about 10:22 p.m. Tuesday to assist Oneida County sheriff’s deputies regarding a man who was armed with a gun and acting erratically, police said.
Upon arrival of the deputies and Treen, Newbill allegedly came out of his home with a high-powered rifle and fired a single round into the air while authorities were still in the roadway, police said. He then began walking towards the officers and refused their commands to drop the weapon, police said.
That’s when Newbill allegedly pointed the rifle at Treen, which prompted the nine-year veteran trooper to fire several rounds from his .233 caliber patrol rifle, police said. Newbill was struck in both hands by Treen’s gunfire, which ended the threat, police said.
“Every law enforcement officer that was at the scene acted the way they were supposed to, they acted professionally according to the training that they received, and they used only the force that was necessary to neutralize the threat,” state police Troop D Capt. Francis Coots said Tuesday.
Newbill was then taken into custody, and none of the officers were injured during the incident, which has not been described as a standoff.
“It was very fluid, very quick moving, and it all happened in a matter of moments,” Coots said. “I think everyone was prepared to use deadly physical force, and it just happened that the guy pointed the gun at the trooper.”
Coots said he did not know if Newbill had made any verbal threats against the police while armed with his weapon.
Newbill was transferred to Syracuse after first being treated at St. Elizabeth Medical Center, and he is currently being guarded by law enforcement officers while felony charges are pending, police said.
He also is expected to be charged by sheriff’s deputies regarding an incident earlier Tuesday evening, when Newbill was driving on Route 26 and allegedly rammed his vehicle into another vehicle, police said.

Brummer Award – Highest Award for Heroism
The Brummer Award, established in 1968 by Wall Street financier and philanthropist Bertram F. Brummer, represents valor, heroism, and outstanding performance of duty by Members of the New York State Police. Inclusive of this year, the Brummer Award has been presented 93 times, including thirteen times posthumously.

On June 22, 2010 Trooper Carlo Gennario was dispatched to a reported domestic dispute in the Town of Vienna, Oneida County. The 911 dispatcher advised that there was a distraught man at that residence with a shotgun, threatening to shoot a baby and any responding law enforcement personnel. Upon arrival, Trooper Gennario observed the man holding a shotgun in one hand and an infant in the other. After exiting his vehicle, Trooper Gennario drew his issued sidearm and ordered the subject to drop the gun. The suspect shot the child and then leveled the shotgun at Trooper Gennario, advancing toward his position, ignoring all commands to drop his weapon. Trooper Gennario fired his pistol at the subject while seeking cover behind his Troop car.
