Essentially, GAO reprimanded the agency for failing to do more in its price evaluation than just consider whether the proposed total labor hours were sufficient to perform the Performance Work Statement tasks.  Specifically, GAO reminded DLA that FAR 8.405-2(d), (e) requires an agency to consider the level of effort and the mix of labor proposed to perform the task being ordered, determine that the total price is reasonable, and document the agency’s price reasonableness determination.  Here, because DLA failed to comply with the FAR, GAO recommended that the agency perform a new evaluation, reopening negotiations with the vendors (if necessary) and make a new selection decision.

GAO also sustained the protest based on DLA’s failure to assess the vendor’s differing strengths or otherwise explain why the quotations were technically equal when the RFQ specified the issuance of a task order based on a best value basis.  Specifically, GAO explained that where a solicitation anticipates the use of a best value evaluation plan, “evaluations of quotations is not limited to determining whether a quotation is merely technically acceptable; rather, quotations should be further differentiated to distinguish their relative quality under each stated evaluation factor by considering the degree to which technically acceptable quotations exceed the stated minimum requirements or will better satisfy the agency’s needs.
